Application and Scope.

Stated below is the Privacy Policy (the “Privacy Policy”) of Brandywine Bookmaking LLC d/b/a Lucky’s  (“Lucky’s,” “we,” “our” or “us”).  This Privacy Policy applies to all web sites owned or operated by Lucky’s, its affiliates and/or subsidiaries, including, without limitation, the web site www.betatluckys.com (the "Lucky’s Web Sites").   Except where expressly stated otherwise, this Privacy Policy applies only to information collected on Lucky’s Web Sites and does not apply to information collected offline or otherwise outside of the Lucky’s Web Sites.

The purpose of this Privacy Policy is to identify the Personal Information we may collect, describe how you can review and make changes to that Personal Information, describe how you can learn about changes to the Privacy Policy, and provide you with a mechanism to opt-out of certain marketing activities.

Types of Information We May Collect.

We collect and use information that we believe will assist in the administration of our business and help us ultimately provide you with better service.  We may collect and maintain several types of information needed for these purposes, including, without limitation, the forms of General Information and Personal Information discussed below.

•    General Information.

When you use the Internet, your web browser or client software may transmit certain information to the servers that host the web sites you visit.  Such information may include, but not be limited to, the unique number assigned to your server or Internet connection, the capabilities and features of your computer hardware and/or software, your geographic location, your movement within a given website and interaction with the web sites you visit, including what pages you look at and what information you download (collectively, “General Information”). When you visit Lucky’s Web Sites, our servers collect such General Information. We then use this General Information to generate aggregate statistics about visitors to the Lucky’s Web Sites.  Whenever possible in our collection of information from Lucky’s Web Sites, we will link General Information to Personal Information.

•    Personal Information.

Lucky’s collects personal information from you whenever you submit such information to a Lucky’s Web Site, including, without limitation, signing up for email notifications, entering any online promotion, requesting information through any Lucky’s Web Site, submitting an application for employment to Lucky’s or providing feedback to Lucky’s in any on-line forum.  "Personal Information" includes, but is not limited to, your name, your date of birth, postal address, e-mail address, telephone number, fax number, gender, credit card information, gaming activity, and your purchasing habits (collectively, “Personal Information”).

We may combine Personal Information with other generally or publicly available information to help us identify your preferences or interests. Your Personal Information may also be merged with Personal Information available from other sources, including (1) e-mail address or postal address append services; (2) credit card verification and credit services; and/or (3) information directly obtained at any Lucky's location.

Information Collected by Partners and Third Parties.

When you are on Lucky’s Web Sites, certain content may be served by a third party. These third parties may install their own cookies and/or use web beacons on your computer, which may be used to identify some of your preferences or to recognize you if you have previously had contact with those third parties. We do not control the use of such technology by third parties, the information they collect, or how they use such information.

Also, we may obtain information about you from business partners and other third party entities that direct you to Lucky's Web Sites (collectively, "On-line Partners").  We may use Personal Information obtained from our On-line Partners in accordance with the terms of this Privacy Policy.  We generally have no control over how our On-line Partners use Personal Information they collect from or about you.  Therefore, if you provide Personal Information to our On-line Partners, we encourage you to consult our On-line Partners’ privacy policies for more information about their privacy protection practices.

How We May Use the Information We Collect.

•    Use for Marketing Purposes.

We may use your Personal Information and General Information (collectively, “Your Information”) for our own marketing purposes, including notifying you of special promotions, offers and events via postal mail, e-mail, telephone, text messaging, and other means. If you do not want us to use your Personal Information for marketing purposes, you may opt-out of such uses by notifying us as prescribed below.

•    Use for Non-Marketing Purposes.

We may use Your Information for purposes unrelated to marketing, including:

(1)    responding to your inquiries, complaints and other communications;

(2)    processing and fulfilling orders for and/or purchases of Lucky’s merchandise;

(3)    contacting you for confirmation or customer service after you order purchases from Lucky’s Web Sites or after you sign up for or participate in certain Lucky’s Web Site activities;

(5)    to help improve Lucky’s Web Sites and services;

In the event that we engage in joint marketing efforts with third party companies, we may share Your Information with other companies in order to effectuate such marketing efforts.  If you do not want us to share Your Information with other companies for marketing purposes you may opt-out of such sharing by notifying us as prescribed below.

•    Information Disclosed to Affiliates.

Your Information be shared for any purpose among Lucky's departments, subsidiaries and affiliates, such purposes include, without limitation: permitting Lucky's to validate your identity; completing purchase transactions; recording gaming related activity; or other legitimate non-marketing business needs.

•    Information Disclosed to Unaffiliated Entities.

Although you may request to opt-out of sharing Your Information for Lucky's marketing purposes, we reserve the right to disclose Your Information to third parties for other non-marketing purposes, including, without limitation the following:

(1)    for purchase fulfillment;

(2)    to comply with any court order, subpoena, search warrant or other valid legal process;

(3)    to comply with legal, regulatory or administrative requirements of any governmental authorities;

(4)    to protect and defend Lucky's, its subsidiaries and affiliates, and all of their officers, directors, employees, attorneys and agents in connection with any legal action, claim or dispute;

(5)    to satisfy any contractual obligation to indemnify its contractors, Partners or other third parties in connection with any legal action, claim or dispute;

(6)    to enforce the Terms of Use of Lucky's Web Sites;

(7)    to prevent imminent physical harm or threats to public safety;

(8)    to third party vendors that Lucky's may use to perform functions on behalf of Lucky's, such as companies that process credit card transactions;

(9)    to prevent fraud;

(10)    to engage in debt collection; and

(11)    for any legal purpose.

Further, certain transactions and services offered while visiting Lucky's Web Sites may be processed or provided by third parties under contract with us for fulfillment and other purposes.  In such cases, we may share Your Information with those Third Parties.

Cookies and Web Beacons.

Lucky’s Web Sites may utilize a website technology known as “cookies” primarily to enhance your online experience.  A cookie is a small text file that contains information sent by a web site that is saved on your hard drive by your computer’s browser. Cookies can either be permanent (i.e., they remain on your computer until you delete them) or temporary (i.e., they last only until you close your browser). Cookies store information that a web site may need to personalize your experience and to gather web site statistical data, such as which web pages you visit, what material you download, your Internet provider’s domain name and country, and the addresses of web sites you visited immediately before and after visiting a particular web site. Lucky's Web Sites use cookies to collect and store your preferences for viewing the Lucky's Web Sites, such as whether you disable a particular function, so that you will not have to disable the same function on following visits. The cookie information may also be used to detect and resolve web site problems and to assist with customer support concerns.

In addition, Lucky's Web Sites utilize cookies to provide a unique identifier to your computer.  This helps us to generate statistics regarding usage of Lucky's Web Sites, such as the percentage of repeat visitors.  In situations where Lucky's has obtained Personal Information, the unique identifiers may be matched with such Personal Information. In addition, when you submit information to any Lucky's Web Site the information may be stored in a cookie on our computer and in files generated by third party vendors that assist in the processing and fulfillment of any services offered by Lucky's Web Sites.

We may also use "web beacons" that monitor your use of our sites. web beacons (or web bugs) are small strings of code that provide a method for delivering a graphic image on a web page for the purpose of transferring data, such as the IP (Internet Protocol) address of the computer that downloaded the page on which the web beacon appears, the URL (Uniform Resource Locator) of the page on which the web beacon appears, the time the page containing the web beacon was viewed, the types of browser that fetched the web beacon and the identification number of any cookie on the computer previously placed by that server. When corresponding with you via HTML capable e-mail, web beacons let us know whether you received and opened our e-mail.

Security of Information.

While Lucky’s strives to secure your Personal Information, even reasonable security measures do not guarantee the security of any information you transmit via the internet, including information submitted to Lucky’s Web Sites. Lucky’s cannot guarantee that information it seeks to protect will be protected under all circumstances, including those beyond its reasonable control.  By accessing Lucky’s Web Sites, you agree that you transmit information to Lucky’s via the Lucky’s Web Site at your own risk.

This website is maintained on servers located within the territorial borders of the United States and subject to its laws, regulations and court precedent.  Any of Your Information collected by us in connection with the Lucky’s Web Sites shall be subject to the privacy and disclosure laws of the United States.      

Children and the Lucky’s Web Sites.

Lucky’s Web Sites are intended for an adult audience.   We do not knowingly collect any information from persons under the age of twenty one (21) and will delete any information later determined to be from a user younger than twenty one (21).

Lucky’s strongly supports parental controls on the Internet and does not condone, sponsor, or otherwise endorse underage gambling.  If you are a parent and wish to block this site, we strongly suggest that you contact one of the following Internet filtering companies:

Telemarketing.

Although you may have registered your telephone number on a Federal or State do not call list, certain exemptions (for example, for communicating with established customers) may allow us to contact you via telephone. Changes to this Privacy Policy.

We reserve the right to change, modify or amend this Privacy Policy at any time without notice. When we change, modify and/or amend this Privacy Policy, the revised Privacy Policy will be posted on one or more of the Lucky’s Web Sites. Any revised Privacy Policy will only apply prospectively to Information (Personal or General) collected or modified after the effective date of the revised policy. You are responsible for periodically reviewing the latest Privacy Policy as posted on Lucky’s Web Sites.
